Social Security Myth #2

     Recently, I wrote that the number one myth about Social Security Disability or SSI is that “everyone that applies for benefits is approved.”  I noted that this myth barely beats out another myth, which is that “my neighbor never worked a day in his life, there is nothing wrong with him, and he draws Social Security Disability.”

     Now, I am not naïve enough, nor blind to the fact that some fraud does occur in the Social Security Disability system.  It exists in all aspects in life.  There is fraud and crimes perpetrated on Wall Street that do and have done far more damage to the American economy than the fraud that invariably occurs by a few unscrupulous actors in the disability system.

     However, if someone was approved for Social Security Disability in today’s system there was some medical evidence presented that satisfied the trier of fact.  Again, there may be some nefarious individuals presenting evidence that is not valid, but rest assured that the Social Security Administration and the Administrative Law Judges do not willy nilly approve benefits without medical prove of severe medical conditions, whether physical and/or mental, resulting in reduction of functional abilities.

     Also, if someone is drawing Social Security Disability then he or she has paid into the system (i.e. worked) or they are drawing off of the account of a family member wage earner under very special and limited circumstances.  The only benefits available to a person that has never worked is usually on Supplemental Security Income (SSI), which is a different, albeit similar, program.

     A lot of variables play into whether a claim is approved.  The Social Security Administration looks at age, education, job skills, as well as mental and physical impairments.
