VA Disability and Determinations by the VA

The Veteran’s Administration makes several determinations in deciding a VA Disability claim for disability compensation.  Those determinations include:

  • Whether the veteran is entitled to disability compensation, and, if the veteran is so entitled?  As discussed in a previous blog post, the basic criteria is:
    Evidence that veterans currently suffers from a disability;
    Evidence of an incident, injury, or event during the veteran’s military service;
    Evidence of a link between the disability and the incident, injury, or event during service.
  • The degree of the veteran’s disability (from 0% to 100%).  For 12/1/09 through 11/30/11:

            10% – $123.00 per month                   60% – $974.00 per month

            20% – $243 per month                         70% – $1,228.00 per month

            30% – $376 per month                                    80% – $1,427.00 per month

            40% – $541 per month                                    90% – $1,604.00 per month

            50% – $770  per month                                   100% – 2,673.00 per month

*Additional compensation available for Dependents (spouse, children, dependent parent) if veteran is rated at least 30% disabled for service-connected (SC) disabilities.

  • The effective date of the award of disability compensation (the effective date is the date from which monthly payments are made).  The effective date is usually, but not always, the date the claim is received by the VA.
