Don’t Hire a Non-Attorney Representative on your Disability Case!

Social Security Disability and SSI claimants should always be wary of incompetent representation. As discussed before, my belief is that part of ensuring competent representation is to hire a licensed attorney experienced in practicing before the Social Security Administration. A recent law review journal written by Drew Swank Non-Attorney Social Security Disability Representative and the Unauthorized Practice of Law discusses some of the pitfalls and liabilities of claimant representation by non-attorneys. Drew Swank is an ALJ with the Social Security Administration and although is allowance rate appears to be on the low side, his position does give him an excellent vantage point to witness and thus comment on the subject of non-attorney representation.

The main point of Judge Swank’s article is that non-attorney representation, as currently allowed by the SSA, does not guarantee competency and this lack of competency can harm the claimant and government alike. Some interesting key points from the article are:

  • Promoting competence and ethical behavior are the twin goals of the unauthorized practice of law doctrine (and should be that of the SSA).
  • If an attorney acts improperly, he or she can be sanctioned by a state bar, sued for malpractice, and punished by a court.
  • Non-attorney representatives are eight times more likely to be suspended or disqualified by the Social Security Administration than attorneys.
  • Non-attorney representatives only have to meet competency standards if they want to be paid faster by the Social Security Administration.
  • Incompetent representation harms the claims and wastes government resources.

I have often said that if someone is going to a court hearing, why go with a non-attorney when a lawyer costs the same?

Social Security – Hiring More Judges?

The SSA is hoping to hire 250 new ALJs this fiscal year and another 250 in fiscal year 2016.  So far 105 ALJs have been hired this year.  However, these new judges are unlikely to reduce the backlog of cases currently pending at the hearing office level since the new judges are just enough to keep up with the amount of ALJs leaving each year.  About 100 to 125 ALJs leave the SSA each year.

Social Security – Appeal a Denial Quickly

What happens if I am denied benefits and I do not appeal within 60 days?

You’ll have to start over with a new application — and it may mean that you’ll lose some back benefits. So it’s important to appeal all denials within 60 days. It’s better if you appeal right away so that you get through the bureaucratic denial system faster. The quicker you can get to the hearing stage the better.

Disability Defined for Social Security

The Social Security Administration defines disability as the “inability to engage in any substantial gainful activity by reason of a medically determinable physical or mental impairment which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.”  42 U.S.C. §§ 423(d)(1)(A), 1382c(a)(3)(A).  Further, an impairment is only considered if the individual is “not only unable to do his previous work, but cannot, considering his or her age, education or work experience, engage in any other kind of substantial gainful work” that exists in the national economy, in the region where the claimant lives, or in several regions of the country.  42 U.S.C. §§ 423(d)(2), 1382c(a)(3)(B). These definitions contain the essential elements necessary to qualify for disability.
